U.S. 1st Circuit Court of Appeals
SKWIRA v. US (09/15/03 - No. 02-1988)U.S. 1st Circuit Court of Appeals
Outside the medical malpractice context, a claim accrues under the
Federal Tort Claims Act once a plaintiff knows, or in the exercise of
reasonable diligence should know of, (1) her injury and (2) sufficient
facts to permit a reasonable person to believe that there is a causal
connection between the government and her injury.

OTTO CANDIES, L.L.C. v. NIPPON KAIJI KYOKAI CORP. (09/17/03 - No.
02-30842)
General maritime law cautiously recognizes the tort of negligent
misrepresentation as applied to vessel classification societies, and on
the facts presented such a society owed a legal duty to a vessel
purchaser.

U.S. 8th Circuit Court of Appeals
EDGLEY v. LAPPE (09/15/03 - No. 02-2303 )

02-1684/8)
District court did not err in 1) granting summary judgment on health
maintenance organizations' damages claim under Minnesota
misrepresentation statutes, as groups did not make a proper case on the
issue of damages; or 2) performing its gatekeeper function under Daubert
and excluding testimony of the organizations' damages expert.

US v. BAXTER INT'L, INC. (09/15/03 - No. 01-16782)
