Take-nothing verdict for defendants was not tainted by jury prejudice
favoring firefighter-defendant as a result of the publicity and
sentiments surrounding the events of September 11, 2001. District court
acted well within its discretion in denying plaintiffs' motions for a
continuance or for a new trial.

KOZIKOWSKI v. TOLL BROS., INC. (12/31/03 - No. 03-1460)
Plaintiffs unsuccessfully appeal the grant of summary judgment to
defendant. Their breach of warranty claims were time-barred, and their
deceit claims were barred by the statute of repose.

In a negligence action brought under section 905(b) of the Longshore
and Harbor Workers' Compensation Act, defendant's vessel might have been
negligent in the maintenance, upkeep, and inspection of the deck in
question, so that it might have discovered the defect or hole in the
decking into which plaintiff fell.

Plaintiff failed to prove that defendant had defamed him by making
untruthful statements about his drug test results to a third party. With
respect to his claim that defendant violated Minnesota's Government Data
Practices Act by disclosing information about the test results,
plaintiff failed to prove that any actual or reputational damages he
sustained were a direct result of the unlawful disclosure.

Just as a malicious prosecution suit may be maintained where only one
of several claims in the underlying action lacked probable cause, so too
can a malicious prosecution action be maintained where most but not all
of the amount sought in the underlying action was claimed without
probable cause.
